MY TZOLK'IN LIFE CONTEST RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN.

Mayan Calendar Portal's "My Tzolk'in Life" Video Contest (the “Contest”) starts on July 17, 2011 at 11:59 PM PST and ends on August 19, 2011 at 11:59 PM PST (“Contest Period”). 

ELIGIBILITY: Contest is open to all people throughout the world who are over the age of majority in his/her jurisdiction and who have internet access. Employees of LUCITÀ (“Sponsor”) and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Also not eligible to enter or win are any parties who: (1) are represented under contract (e.g. by a talent agent, manager, or other party) that would limit Sponsor’s rights in the Entry and ability to use and show the Entry in any media form as authorized below; 2) have an acting or modeling or other contract that would make their appearance in the Entry a violation of third party rights; or (3) are under any other contractual relationship or are a member of any guild or union that may prohibit them from participating fully in the Contest or present Sponsor from using, residual-free, the Entry worldwide in all media in perpetuity.  Void where prohibited by law. Contest is subject to all applicable federal, state, provincial/territorial, and local laws.

HOW TO ENTER:

During the Contest Period, produce a video (“the Video”) that conveys the message of our foundation and promotes critical thinking in particular as it relates to religion and public policy (collectively, with entry form, “Entry”). To enter the Contest, you must fully complete the submission form at http://www.maya-portal.net/submit/content and submit your Video with the submission form. Entries cannot exceed 5 minutes in length.  All Entries must be received by August 19, 2011 at 11:59 PM PST to be considered eligible. Entries generated by script, macro or other automated means are void. Limit one (1) Entry per person and per email address. Entries received from any person or email address in excess of the limitation will be void.  Entries will be rejected if : (a) entry form is not fully completed and submitted along with your Video during the Contest Period; or (b) if the Entry does not conform to the specific requirements listed below.  Without limitation, the Sponsor is not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries.  All Entries become the sole property of the Sponsor and will not be returned. 

BY SUBMITTING AN ENTRY, THE ENTRANT AGREES THAT THE ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE OFFICIAL RULES.  THE SPONSOR WILL BEAR NO LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE ENTRY BY THE SPONSOR AND THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE OFFICIAL RULES.

REQUIREMENTS OF ENTRIES:

Your entry shall not contain, as determined by the Sponsor, in its sole discretion, any content that:

 

  • is unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous;
  • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about other people, companies, or organizations;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission (for example, any clothing worn by persons appearing in your Video must not contain any visible logos, trademarks, or other third party materials, unless the necessary permissions/licenses have been obtained or such materials blurred out); contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains copyrighted or copyright protected materials where the copyright is owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, music, or other media), without express written permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.  For greater certainty, this means your Video must not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction or residence; (Note:  If you cannot obtain the consent of an individual appearing in your Video, then his/her face must be blurred out);
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate;
  • contains any singing, playing of any musical instrument, or performance that has been broadcast, published or televised as part of a recording or motion picture film, music performance, or television program;
  • contains any other content that is or could be considered inappropriate, unsuitable, or offensive, all as determined by the Sponsor in its sole discretion; and/or
  • violates any law.

 

Entry must be the original work of the entrant, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity, moral rights, or other intellectual property or other rights of any person or entity.  If the Entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry and in writing, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules.  This includes, without limitation, permission from the videographer, as well as name and likeness permissions from any person (and their parent or legal guardian if they are under the age of majority in their jurisdiction of residence) who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void.  By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein.

Each entrant agrees to reimburse Sponsor and other Released Parties (as defined below) in full in respect of any expense, cost, or liability incurred by Sponsor or any other Released Party as a result of any claims of infringement or other breach of intellectual property or other rights by any third party resulting from Sponsor or other Released Party’s use of any element of the entrant’s Entry as authorized by these Official Rules. 

 

For all Entries:

By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.maya-portal.net or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Prior to being posted online, the Sponsor reserves the right, in its sole discretion, to edit or modify any Entry, or to request an entrant to modify or edit his or her Entry, in order, to ensure that the Entry complies with these Official Rules, or for any other reason. 

 

Judging Phase: Beginning on or about July 18, 2011, all eligible Entries received by Sponsor during the Contest Period will be judged to select thirteen (13) finalists (“Finalists”) by a panel of qualified judges (Sponsor’s trustees, advisors, and their colleagues) based on the following criteria (weighed equally): (i) expressing the story of the MCP's Daily Energies; (ii) creativity, (iii) production quality (iv) level of entertainment. (the “Judging Criteria”).  In the event of a tie, an additional, “tie-breaking” judge will judge all such Entries that are tied to determine the Finalist(s) based on the criteria listed herein.  Sponsor reserves the right to declare fewer than thirteen (13) Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules.  Judging will be completed and the Finalist(s) will be contacted by email, mail, or phone (see below) by August 30, 2011.  If you have not been contacted by this date, you may assume that you are not a Finalist. 

Subject to verification of eligibility and compliance with these Official Rules, the Finalist that receives the highest number of valid votes, as determined by Sponsor, will be deemed the “Grand Prize winner”; the Finalist that receives the second highest number of valid votes, as determined by Sponsor, will be deemed the “Second Place winner”; and the Finalist that receives the third highest number of valid votes, as determined by the Sponsor, will be deemed the “Third Place winner.”  In the event of a tie based on the total number of valid votes received during the Voting Period, a “tie-breaking” judge will determine the Grand/Second/Third (as appropriate) Prize winner based on the Judging Criteria.  Use of script, macro or any automated system to vote or with the intent to impair the integrity of the voting process is prohibited and all such votes will be void.  For the purpose of these rules, the Grand Prize winner, the Second Place winner, the Third Place winner, and the Finalists may be referred to herein collectively as “winners” and each as a “winner” (although any use of the word “winner” is subject to that individual’s compliance with these Official Rules.).

FINALIST NOTIFICATION:  Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest, without right of appeal.  Potential finalists will be notified by telephone, mail and/or email and may be required to complete an Affidavit, Declaration, or Certificate of Eligibility, Liability and Publicity Release (unless prohibited by law), any releases to use any material or elements subject to third party rights in the entry and for the Sponsor to use and exhibit the entry, and any other documents (e.g. assignment of copyright and waiver of moral rights) required by Sponsor, which must be returned within ten (10) days of date appearing on the finalist notification.  Return of the finalist notification as undeliverable, failure to sign and return requested documentation within the specified time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the finalist spot may be awarded to a runner-up.  If any potential finalist is an eligible minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on Finalists set forth herein.

WINNER NOTIFICATION: Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest, without right of appeal.  Potential winners will be notified by telephone, mail and/or email and may be required to complete an Affidavit, Declaration, or Certificate of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents (e.g. assignment of copyright and waiver of moral rights) required by Sponsor, which must be returned within 10 days of date appearing on prize notification.  Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to a runner-up. If any potential winner is an eligible minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.

 

PRIZES:  The Grand Prize winner will receive a complimentary one-year MCP Membership.  The Second Place winner will receive a complimentary one-year MCP Membership.  The Third Place winner will receive a complimentary one-year MCP Membership.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value.  Any additional prize details are at Sponsor’s sole discretion.  Without limitation, the Sponsor is not responsible for the distribution of any prize between any persons who may have participated in making the Entry.

 

GENERAL CONDITIONS:

By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries; (b) to release, discharge and hold harmless Sponsor, and its parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize and (c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.  By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Contest without the prior written consent of the Sponsor, which it may withhold in its sole discretion. 

OWNERSHIP/USE OF ENTRIES:  Entrants will retain ownership of their Entries.  However, by entering this Contest, entrants grant Sponsor and all other Released Parties a royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, distribute, exploit, and use Entries and the content of and elements embodied in the Entries, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.  By entering this Contest, entrants represents and warrants that the above described license to the Sponsor does not violate any third party rights or agreements.  Each entrant hereby waives any claim that the entrant may otherwise now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair competition law in respect of Sponsor or any other Released Party’s use of the Entry as authorized by these Official Rules.  Entrants also agree not to instigate, support, maintain, or authorize any action, claim or lawsuit against Sponsor and any other Released Party on grounds that any use of the Entry as authorized by these Official Rules infringes or violates any rights of any entrants. 

ENTRANT DATA:  All personal information collected will be used in accordance with the Privacy Policy, unless the entrant otherwise agrees.

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, illegible, stolen, delayed, misdirected, undelivered, or garbled Entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the tabulation of votes, the announcement of the prizes, the incorrect uploading of the Video or in any Contest-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest.  Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion, to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

In the event of a dispute regarding who submitted an Entry, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry, “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry.  The sole determinant of the time for the purposes of a valid online entry is this contest will be the contest server machines(s).

The Sponsor reserves the right to cancel or suspend this Contest or to amend these Official Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.
